法律的式微

马德里—在评估2014年全球事件和趋势时,混乱、失序、分裂等词汇或许会主宰我们的脑海。但“软”字也应该出现。事实上,2014年的一大特征是持续涌现出“软”工具解决全球挑战:承诺、判令、自我监管、联合行动以及握手达成协议。根据传统的正是法律组织全球关系的时代结束了吗?

当然,这一朝向“软”法律的转变也发生在你国内环境中。在美国,总统奥巴马利用行政权力绕过国会实施移民改革。在超国家层面,新欧盟委员会正在追求其“更加监管”的目标的过程中尽可能少地使用正式立法程序,将注意力集中于建议、行为准则和指引上。

但国际法的式微最显而易见的仍然是国际领域。G-20的决定越来越不正式,而规则制定权被外包给了私人监管机构,如巴塞尔委员会(Basel Committee)和国际会计准则委员会(International Accounting Standards Board)
