TERMS OF SERVICE

This page describes the terms and conditions that govern your use of certain Project Syndicate digital products, including project-syndicate.org, offered by Project Syndicate (“PS”, “us” or “we”). For information on how Project Syndicate collects, uses and shares any personal information, please see our Privacy Policy.

1. GENERAL RULES AND DEFINITIONS

1.1 If you choose to use project-syndicate.org, PS’s mobile sites, any of the features of this Site, including but not limited to RSS, API, software and other downloads (collectively, the “Services”), you will be agreeing to abide by all of the terms and conditions of these Terms of Service between you and Project Syndicate (“PS”, “us” or “we”).

1.2 We may change, add, or remove portions of these Terms of Service at any time, which shall become effective immediately upon posting. It is your responsibility to review these Terms of Service prior to each use of the Site and by continuing to use this Site, you agree to any changes.

1.3 If any of these rules or any future changes are unacceptable to you, you may cancel your membership by sending an email to: support@project-syndicate.org.

(See section 9.1 regarding termination of service.) Your continued use of the services now, or following the posting of notice of any changes in these operating rules, will indicate acceptance by you of such rules, changes, or modifications.

1.4 We may change, suspend, or discontinue any aspect of the Services at any time, including the availability of any Services feature, database, or content. We may also impose limits on certain features and services or restrict your access to parts or all of the Services without notice or liability.

2. CONTENT ON THE SERVICES

2.1 The contents of the Services, including the Site, are intended for your personal, noncommercial use. All materials published on the Services (including, but not limited to news articles, photographs, images, illustrations, audio clips and video clips, also known as the “Content”) are protected by copyright, and owned or controlled by Project Syndicate or the party credited as the provider of the Content. You shall abide by all additional copyright notices, information, or restrictions contained in any Content accessed through the Service.

2.2 The Services and Contents are protected by copyright pursuant to U.S. and international copyright laws. You may not modify, publish, transmit, participate in the transfer or sale of, reproduce (except as provided in Section 2.3 of these Terms of Service), create new works from, distribute, perform, display, or in any way exploit, any of the Content or the Services (including software) in whole or in part.

2.3 You may download or copy the Content and other downloadable items displayed on the Services for personal use only, provided that you maintain all copyright and other notices contained therein. Copying or storing of any Content for other than personal use is expressly prohibited without prior written permission from Project Syndicate, or the copyright holder identified in the copyright notice contained in the Content.

2.4 The Content of the Services is owned or licensed to PS.

3. USER GENERATED CONTENT: SUBMISSIONS INCLUDING COMMENTS, READER REVIEWS AND MORE

3.1 You shall not upload to, or distribute or otherwise publish on to the Services any libelous, defamatory, obscene, pornographic, abusive, or otherwise illegal material.

Be courteous. You agree that you will not threaten or verbally abuse other members, use defamatory language, or deliberately disrupt discussions with repetitive messages, meaningless messages, or “spam.”

Use respectful language. Like any community, the online conversation flourishes only when our Members feel welcome and safe. You agree not to use language that abuses or discriminates on the basis of race, religion, nationality, gender, sexual orientation, age, region, disability, etc. Hate speech of any kind is grounds for immediate and permanent suspension of access to all or part of the Services.

Debate, but don’t attack. In a community full of opinions and preferences, people always disagree. PS encourages active discussions and welcomes heated debate on the Services, but personal attacks are a direct violation of these Terms of Service and are grounds for immediate and permanent suspension of access to all or part of the Service.

3.2 The Services shall be used only in a noncommercial manner. You shall not, without the express approval of PS, distribute or otherwise publish any material containing any solicitation of funds, advertising, or solicitation for goods or services.

3.3 You acknowledge that any submissions you make to the Services (i.e., user-generated content including but not limited to: comments, forum messages, reviews, text, video, audio and photographs, as well as computer code and applications) (each, a “Submission”) may be edited, removed, modified, published, transmitted, and displayed by Project Syndicate and you waive any rights you may have in having the material altered or changed in a manner not agreeable to you. Submissions made to the Services may also be included in our RSS feeds, APIs, and made available for republishing through other formats.

3.4 You grant PS a perpetual, nonexclusive, world-wide, royalty free, sub-licensable license to the Submissions, which includes without limitation the right for PS or any third party it designates, to use, copy, transmit, excerpt, publish, distribute, publicly display, publicly perform, create derivative works of, host, index, cache, tag, encode, modify, and adapt (including without limitation the right to adapt to streaming, downloading, broadcast, mobile, digital, thumbnail, scanning or other technologies) in any form or media now known or hereinafter developed, any Submission posted by you on or to the Services or any other website owned by PS, including any Submission posted on or to the Services through a third party.

3.5 You are solely responsible for the content of your Submissions. However, while PS does not and cannot review every Submission and is not responsible for the content of these messages, PS reserves the right to delete, move, or edit Submissions that it, in its sole discretion, deems abusive, defamatory, obscene, in violation of copyright or trademark laws, or otherwise unacceptable.

3.6 By making a Submission, you are consenting to its display and publication on the Site and in the Services and for related online and offline promotional uses.

3.7 Any person involved in or affiliated with the production of a work reviewed on project-syndicate.org or elsewhere in the Services may not submit a Readers’ Review for that work or competing works.

4. USE OF THE SERVICES

4.1 You may not access or use, or attempt to access or use, the Services to take any action that could harm us or a third party. You may not access parts of the Services to which you are not authorized. You may not attempt to circumvent any restriction or condition imposed on your use or access, or do anything that could disable or damage the functioning or appearance of the Services.

4.2 The Services contain links to other related internet sites and resources. Since we are not responsible for the availability of these outside resources, or their contents, you should direct any concerns regarding any external link to such site.

5. REPRESENTATIONS AND WARRANTIES

5.1 You represent, warrant and covenant (a) that no materials of any kind submitted through your account will (i) violate, plagiarize, or infringe upon the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights; or (ii) contain libelous or otherwise unlawful material; and (b) that you are at least thirteen years old. You hereby indemnify, defend and hold harmless PS and all officers, directors, owners, agents, information providers, affiliates, licensors, and licensees (collectively, the “Indemnified Parties”) from and against any and all liability and costs, including, without limitation, reasonable legal fees, incurred by the Indemnified Parties in connection with any claim arising out of any breach by you or any user of your account of these Terms of Service or the foregoing representations, warranties, and covenants. You shall cooperate as fully as reasonably required in the defense of any such claim. PS reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

5.2 PS does not represent or endorse the accuracy or reliability of any advice, opinion, statement, or other information displayed, uploaded, or distributed through the Services by any user, information provider, or any other person or entity. You acknowledge that any reliance upon any such opinion, advice, statement, memorandum, or information shall be at your sole risk. The services are distributed on an “as is” basis  without warranties of any kind, either express or implied, including, without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose. You hereby acknowledge that use of the services is at your own risk.

6. REGISTRATION AND SECURITY

6.1 As part of the registration or account creation process, you will create login credentials by selecting a password and providing an email address. You also have to give us certain registration information, all of which must be accurate and updated.

Each registration is for a single user only. You are not allowed to share your registration login credentials or give your login credentials to anyone else. We may cancel or suspend your access to the Services if you share your login credentials. You are responsible for maintaining the confidentiality of your password, which you will not have to reveal to any representative or agent of PS. You may not (i) select or use the login credentials of another person with the intent to impersonate that person; (ii) use login credentials in which another person has rights without such person’s authorization; or (iii) use login credentials that we, in our sole discretion, deem offensive. Failure to comply with the foregoing shall constitute a breach of these Terms of Service, which may result in immediate suspense or termination of your account.

6.2 Please notify support@project-syndicate.org of any known or suspected unauthorized use(s) of your account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your password or credit card information.

6.3 You must be 13 years or older to subscribe to all parts of the Services.

6.4 You are responsible for all usage or activity on your project-syndicate.org account, including use of the account by any third party authorized by you to use your login credentials. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your account, at our sole discretion, and we may refer you to appropriate law enforcement agencies.

7. FEES AND PAYMENTS

7.1. We reserve the right at any time to charge fees for access to portions of the Services or the Services as a whole. However, in no event will you be charged for access to the Services unless we obtain your prior agreement to pay such charges. Thus, if at any time we require a fee for portions of the Services that are now free, we will give you advance notice of such fees. You may cancel your account at any time. All new fees, if any, will be posted prominently on the Site and in other appropriate locations on the Service. You shall pay all fees and charges incurred through your account at the rates in effect for the billing period in which such fees and charges are incurred, including, but not limited to charges for any digital products or services offered for sale through the Services by us or by any other vendor or service provider. All fees and charges shall be billed to and paid for by you. You shall pay all applicable taxes relating to use of the Services through your account.

8. SOFTWARE LICENSES

8.1 You shall have no rights to the proprietary software and related documentation, or any enhancements or modifications thereto, provided to you in order to access the Services (“Software”). You may not sublicense, assign, or transfer any licenses granted by proejct-syndicate.org, and any attempt at such sublicense, assignment, or transfer shall be null and void. You may make one copy of such software for archival purposes only. You may not otherwise copy, distribute, modify, reverse engineer, or create derivative works from Software.

9. TERMINATION

9.1 You may terminate your account at any time by emailing us at support@project-syndicate.org. Upon termination, your access will be suspended within 24 hours. Termination of paid digital products will be governed by our Cancellation and Refund Policy for Digital Products.

9.2 PS may, in its sole discretion, terminate or suspend your access to all or part of the Services for any reason, including, without limitation, breach, or assignment of these Terms of Service.

10. MISCELLANEOUS

10.1 These Terms of Service have been made in and shall be construed and enforced in accordance with New York law. Any action to enforce these Terms of Service shall be brought in the federal or state courts located in New York City.

10.2 Nothing in these Terms of Service will serve to preempt the promises made in the Privacy Policy.

10.3 Correspondence should be sent to support@project-syndicate.org.

10.4 If you believe that your work has been copied in a way that constitutes copyright infringement, please provide us the following information. Please be advised that to be effective, the notice must include ALL of the following:

1. a physical or electronic signature of the person authorized to act on behalf of the owner of an exclusive copyright that is allegedly infringed;
2. a description of the copyrighted work that you claim has been infringed;
3. a description of where the material that you claim is infringing is located on the Site;
4. your address, telephone number, and email address and all other information reasonably sufficient to permit us to contact you;
5. a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
6. a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

TERMS OF SALE

11. GENERAL TERMS OF SALE

11.1 Definitions

The term “digital product” refers to paid digital products available from Project Syndicate, including both digital subscriptions and one-time purchases.

11.2 About Digital Products

You are not required to purchase anything for certain limited use of project-syndicate.org. However, if you do not purchase a subscription, your access to Project Syndicate content and services will be limited.

Project Syndicate reserves the right to modify the content, type, and availability of any digital product at any time.

Only one person may use the user name and password associated with a digital product account.

You can find detailed information about your purchases, including payment methods and billing cycles on your account page at project-syndicate.org.

11.3 Processing and Payment

Project Syndicate will process your purchase as promptly as possible. There may be a delay in the activation of your product while payment details are verified.

We accept major credit cards and PayPal. We reserve the right to reject any order or purchase at any time.

If your initial payment authorization is later revoked, your subscription, product, or access will be terminated. Contact us at support@project-syndicate.org if you believe your access was terminated in error.

Unless specified otherwise in the Cancellation and Refund Policy, all charges are nonrefundable.

11.4 Pricing

When you purchase a digital product, you agree to pay the price that is stated at the time of your order. You also agree to the billing frequency stated at the time of your order.

Discount eligibility is determined at the time of the order. Discounts cannot be applied retroactively.

All prices are in United States Dollars ($), unless otherwise stated.

Project Syndicate reserves the right to change prices and fees at any time. We will notify you in advance if the regular rate of a product changes from what was stated at the time of your order. You will have the opportunity to accept the new price or cancel your subscription or purchase from that point forward.

If a stated price is determined by us in our sole discretion to be in error, we are not under any obligation to offer you the product at that price. We will notify you of the error and give you the opportunity to cancel your order and obtain a refund if payment has already been made.

Additional Costs

Your subscription may not include access to all areas of the digital product, and you may have to pay additional fees for full access. These additional charges will be clearly stated.

When you use your digital product, you may incur other additional charges from third party service providers, such as telecommunications fees, data fees, or service provider fees. You are responsible for paying any additional charges.

If you believe someone else has used your account or you are being charged for a product you do not have, please contact us.

11.5 Billing

11.5.1 Billing of Digital Subscriptions

We will charge or debit your payment method at the beginning of your subscription. Billing will continue according to the cycle stated at the time of your order.

To view information about your billing cycle, visit your user account at project-syndicate.org.

All Project Syndicate digital subscriptions are renewed automatically. When we renew your subscription, we will use the payment method currently associated with your account. You can view your payment method at any time in your user account at project-syndicate.org.

In most cases, you will be notified two weeks in advance of impending. Please see our Cancellation and Refund policy below for information about canceling.

11.5.2 Billing of One-Time Purchases

When you make a one-time purchase, we will charge or debit your payment method at the time of purchase.

11.5.3 Currency

The currency in which you will be billed will be stated during the purchase process and is determined based on your billing address.

11.6 Unpaid Charges

If your credit card expires or your payment method is otherwise invalid, your subscription or product will not automatically be terminated. You will remain responsible for all charges.

You will be responsible for all costs we incur in connection with the collection of unpaid amounts, including court costs, attorneys’ fees, collection agency fees and any other associated costs.

12. GIFTS

For gift purchases, you have the option to supply a recipient email address and date for the recipient to be informed of the gift, following your purchase. If an email address is not entered, the recipient will not be notified.

An email containing a gift voucher is sent to the recipient email address you provide on the date you choose. Alternatively, you can print or share the gift voucher with the recipient. Please note that any URL to a gift is only valid for 48 hours. If the URL expires, you will need to generate a new URL via your profile page, under the “Purchased Gifts” tab. As a third option, the recipient can navigate to https://www.project-syndicate.org/redeem and enter the gift code. The voucher, email, and redeem page will also include a short gift message that you provide during the order process. Please note, access to a gift subscription will begin once the code is redeemed by the recipient.

For gifts that include print products, you can optionally provide a recipient delivery address. The product will not be shipped to the recipient until the recipient has confirmed the address. If you have opted to notify the recipient, the recipient can edit the delivery address by clicking on the link contained in the notification email. If the recipient is not notified, you will have to share the gift voucher with the recipient or the recipient will have to navigate to this page and enter the gift code.

The redemption email will not be sent until the purchase transaction has successfully been charged and, if you have set a custom delivery date, until the custom delivery date. You can also find the gift voucher in your profile page under “purchased gifts”. You can share the voucher with the gift recipient if they do not receive an email from Project Syndicate or are unable to find the email or if you have selected not to notify the recipient. Project Syndicate is not responsible for electronic notifications nor physical products which do not reach the intended recipient.

12.1 Validity

Gift vouchers are valid for 360 days from the date of purchase. If the recipient does not redeem the gift during this time, the voucher is forfeited.

If that date has passed and the recipient still has not received the redemption email, or if you are unable to find your confirmation email, please contact subscription support by emailing us at support@project-syndicate.org.

The full purchase price for gift subscriptions will be charged at the time of purchase and is nonrefundable.

12.2 Purchases and Billing

Gift subscriptions are one-time purchases unless you select the recurring subscription option. In which case you will be notified of the pending renewal before the expiration of the current subscription. For more information, see the Terms of Sale. Redemption codes are not replaceable.

13. CANCELLATION AND REFUND POLICY

13.1 Cancellation and Refunds of Digital Subscriptions

When you cancel a subscription, you cancel only future charges associated with your subscription. You may notify us of your intent to cancel at any time, but the cancellation will become effective at the end of your current billing period. 

Except in the case of certain promotions, you can change or cancel your digital subscription at any time by emailing us at support@project-syndicate.org. Group Subscription billing cycles and terms of cancellations may differ and are governed by the terms set forth in the Group Subscription Purchase Order.

Cancellations are effective the following billing cycle. You will not receive a refund for the current billing cycle. You will continue to have the same access and benefits of your product for the remainder of the current billing period.

We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.

Changes to Content or Access

We reserve the right to make changes to our digital products at any time. If we temporarily reduce or eliminate the charge for content or access that you are currently paying for under different terms, you will not receive a refund.

Cancellations by Us

We reserve the right to suspend or terminate your subscription or product for any reason, with or without notice and without further obligation. You will not be entitled to a refund in these circumstances. If any or all of our digital products are temporarily unavailable, you will not receive a refund. We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.

13.2 Cancellation and Refunds of One-Time Purchases

One-time purchases cannot be canceled or refunded.

We reserve the right to make changes to our digital products at any time. If we temporarily reduce or eliminate the charge for content or access that you are currently paying for under different terms, you will not receive a refund.

If any or all of our digital products are temporarily unavailable, you will not receive a refund. We reserve the right to issue refunds or credits at our sole discretion. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future.

Terms and Conditions of the Project Syndicate Book Award

Entry Rules:

1. By submitting an entry for the Sustainability Book Award competition, publishers agree to these terms and conditions and acknowledge that failure to comply with them may result in disqualification. It is the responsibility of entrants to ensure that their participation in the competition is in compliance with local laws and regulations, and Project Syndicate is not liable if an entrant has breached local laws and/or regulations in connection with the Sustainability Book Award competition.

2. All entries must be submitted by publishers holding the English-language rights to the title via the dedicated book award website – bookaward.project-syndicate.org – hosted by Project Syndicate.

3. There is no limit on the number of titles that a publisher may submit.

4. The deadline for entry is Tuesday, January 31, 2023.

5. Publishers must include all relevant information fields on the submission form and upload a complete PDF file of the book (or equivalent electronic version).

6. Hard copies should be sent only upon request. If requested, publishers must furnish Project Syndicate with a minimum of eight (8) copies, no later than Wednesday, February 15, 2023.

7. Jurors’ decisions are final.

8. By submitting a title, you confirm that it does not infringe copyright or other intellectual property rights and does not defame or violate the privacy rights of any third party, or infringe any other legal rights, regulations, or laws.

9. Project Syndicate reserves the right to cancel, suspend, or amend the competition, or any part of it (including these Terms and Conditions) or change the prize (to one of equivalent or greater value). Project Syndicate reserves the right to disqualify entrants who have not complied with the spirit of these Terms and Conditions. Non-enforcement by Project Syndicate of any provision of these Terms and Conditions shall not constitute a waiver of that provision.

10. Project Syndicate accepts no liability arising from participation in the competition or receiving an award. Project Syndicate gives no warranty or guarantee in relation to the prize and accepts no responsibility or liability for amendment of the prize. To the fullest extent permitted by law, Project Syndicate is immune from liability for loss, damage, or claims arising as a result of the participant’s entry into the competition or use of the prize.

11. By entering the competition, entrants agree to indemnify Project Syndicate for damage, injury, or loss to any person or property relating, directly or indirectly, to participation in the competition, or for claims based on publicity rights, third-party intellectual-property rights, defamation, or invasion of privacy.

12. Any personal data which may be submitted in an entry will be processed by Project Syndicate in accordance with applicable data protection legislation and the Project Syndicate Privacy Policy, available here.

13. The winner’s full name (including any shortlisted authors) and title of book may be published. If you do not want this information published, please inform Project Syndicate upon entry in the form field.

14. These terms and conditions are governed by the laws of the State of New York, and the courts of the State of New York shall have jurisdiction over any disputes arising in connection with this competition. Publishers hereby submit to the exclusive jurisdiction of the courts of the State of New York.


Terms and Conditions of the Project Syndicate Referral Program

Terms and Conditions of the Project Syndicate Referral Program 

The Project Syndicate Referral Program (“Referral Program”) has been implemented by The Project Syndicate, with its registered office at 9 Bay Colony Court, East Hampton, NY 119 37, United States of America, company ID: 26 - 146 99 01 (“Project Syndicate”) to allow registered users of project-syndicate.org or Project Syndicate’s mobile sites (“Services”) the possibility to earn credits by referring the Services to new users in accordance with these referral conditions (“Referral Conditions”).

Who can use the Referral Program?

The Referral Program is available to any user registered in accordance with the General Terms and Conditions (“User”). The General Terms and Conditions and the Privacy Policy apply in full to the User. If there is any discrepancy between the Referral Conditions and the General Terms and Conditions or Privacy Policy, the General Terms and Conditions or Privacy Policy shall prevail. The User is deemed to have consented to the Referral Conditions upon his/her participation in the Referral Program.

How to use the Referral Program?

Participation in the Referral Program is available to any User free of charge and requires no registration. Project Syndicate may, from time to time, provide Users a unique code (“Code”) that, when used, provides a discount for a potential user of the Services (“Potential Users”). The User is entitled to personally share the Code with anyone by any means, in particular through email, social networks, or other electronic communication. Potential Users may use the Code when registering for Services. The Code is entered when the Potential User registers for the Services. The Code may not be exchanged for cash or for any other discount or service. The Code has a limited validity of up to 30 days; after this period no Potential User can use the Code. A Potential User may use only one Code.

The Codes are to be used for non-commercial purposes only. Users are prohibited from sharing them via unsolicited emails or with multiple Potential Users through services of a commercial nature.

What are Benefit Points?

For each Potential User who subscribes to the Services and uses the Code, the User providing the Potential User with the Code will receive benefit points, as indicated by Project Syndicate at (“Benefit Points”). Once Benefit Points have been earned, they will appear in the User’s account with Project Syndicate. Benefit Points can only be redeemed through Project Syndicate and can be used by the User primarily as a discount for the Services. Project Syndicate may offer Users the possibility to exchange Benefit Points for other gifts or may give Users the possibility to transfer Benefit Points to other Users.

How long are the Benefit Points valid?

Users have one year from receiving the Benefit Points to use them.

What other conditions apply?

Project Syndicate is entitled to change, suspend, or discontinue any aspect of the Referral Program at any time without prior notice; the User will be notified though its Project Syndicate account. By continuing to participate in the Program after any modification, the User is deemed to have consented to that modification.

Project Syndicate reserves the right to suspend the User’s participation in the Referral Program if the User commits any fraudulent activity or acts in violation of the General Terms and Conditions.

If the User terminates use of the Services or withdraws from the General Terms and Conditions, all Benefit Points will be cancelled without compensation.

The User is responsible for any tax or accounting consequences which relate to the Benefit Points.

If any provision in the Referral Conditions is found to be invalid, void, or unenforceable it does not affect the validity and enforceability of the remaining provisions.

These Referral Conditions have been made in and shall be construed and enforced in accordance with New York law. Any action to enforce these Terms of Service shall be brought in the federal or state courts located in New York City.
