金融监管者的罚款之乱

华盛顿—当一名运动员犯规时,要指出相关纪律机构是否想阻止重复犯规时很容易的。把选手罚出场——比如足球比赛中的危险犯规情形——是实实在在的惩罚,不仅惩罚个体,也惩罚了团队。

以澳大利亚板球队队长迈克尔·克拉克(Michael Clarke)为例。在最近的一场比赛中,他对一位对方选手构成了人身威胁。尽管他的行为引起了公愤,但澳大利亚板球协会(治理机构)只是罚了一小笔款(相对于克拉克的年薪而言)了事。不管这一惩罚是否合适,澳大利亚板球协会释放出明确的信号,这样的行为只会受到象征性惩罚。

最近,美国司法部和世界最大的国际银行摩根大通(JP Morgan Chase)达成了130亿美元的和解,该案也适用于上面的道理。对不知情者来说,这笔罚款不可谓不巨(这也是这则新闻吸引眼球的原因),也显然让美国金融监管者有了繁忙且严肃的形象。但是,和澳大利亚板球协会一样,美国司法部释放了明确的信号:马照跑,舞照跳。
