寻求法律的非洲

伦敦—在非洲经商的经历让我成为一名追求更好、更清廉的政府和法治精神的活跃分子。但追求好治理并不仅仅是鼓励最高层的好领导(尽管我相信这毫无疑问是大有裨益的);还要求我们所有人能够承担起作为公民的责任、实现作为公民的权利。

不少非洲国家都拥有令人印象深刻的法律武器——独立的法院系统;但挑战在于不偏不倚的执行。民主问责要求公民能够使用法律,也受法律约束。比如,这些国家都有禁止在未经正当程序和补偿所有者的情况下征收土地的法律;有禁止公职人员收受贿赂的法律;也有要求政府资金用于公共品而不是个人利益的法律。

在最新的易卜拉欣非洲治理指数(Ibrahim Index of African Governance)中名列前茅的国家——博茨瓦纳、加纳、南非等——公民可以使用法律保护自己和他们的产权不受非法侵占,也可以得到公正的纠纷解决。在该指数垫底的国家——索马里、民主刚果和中非共和国——法治精神仍是一个神话,有待走进现实。
