美国剑桥—对于从某些角度堪为美国最大银行的跨国金融服务企业摩根大通公司(JPM)来说,最近几周日子可谓难过。它家两名交易员遭到了起诉,此外它还同意缴纳十亿美元罚款,原因是其报告“伦敦鲸”损失不够迅速,也不够准确。如今,JPM因为它在金融危机期间买下的两家企业——贝尔斯登(Bear Stearns)和华盛顿互助银行(Washington Mutual)的按揭行为而面临更大规模的罚款,也许将超过100亿美元。

传统智慧认为,既然这些篓子和错误爆发于金融危机期间,美国政府就不应该盯着JPM不放。比如,如果实际发生在2012年初的伦敦鲸交易发生在2008年金融系统孱弱不堪时,JPM就会被网开一面。

这一观点似乎颇有道理,因为随后政府集中对大银行予以了扶持以克服金融危机。进一步削弱大银行可能会加深和延长危机。因此,从这个角度出发,JPM相当的不幸:太多的法律问题发生在金融危机之后,或者在金融危机之后才被曝光。
