伯克利——美国医疗平价法案(ACA)及巴拉克·奥巴马总统2010年医疗改革签名已经显著增强了医疗保险市场的有效反垄断执法需求。尽管最近在这方面有不少好消息,但局面仍然不利于消费者。

伯克利经济学教授艾伦·艾林指出,消费者放弃权利才是最终的对手。企业无法为坚持“我就要买这个”的消费者购买或设计解决方案。但ACA要求个人购买医疗保险,并因此为潜在的垄断企业创造出垂直的需求曲线。在这样的条件下,利润——和消费者陋习——可以通过串通来实现最大化。

于是乎不出所料,2015年Anthem、Cigna、Aetna和Humana等某些规模最大的美国私人医疗保险公司开始探索合并的可能。如果能将全国性保险公司从五个减少到三个,他们就能进一步强化市场力量并从消费者那里榨取更多利润。
