主权债务的一大飞跃

发自纽约——每一个先进的国家都有破产法,但对于主权借款人却没有相应的框架。正如我们在希腊和波多黎各看到的一样,这一法律真空将导致经济体丧失活力。

九月,联合国为填补这个空白迈出了一大步,批准了一套主权债务重组原则。这九项原则是—— 主权启动债务重组的权利,主权豁免权,公平对待所有债权人,获得(超)多数同意重组,透明性,公正性,合理性,可持续性,以及在诚信谈判——形成一个有效的国际化法律规则雏形。

这些原则获得了联合国会员国136票赞成,仅6票反对(以美国为首)的压倒性支持,显示全球对及时解决债务危机的需求已经形成了一定的共识。但下一步——建立一个约束所有国家的全球性破产制度国际条约——可能更困难。
