华盛顿—在最新的国情咨文中,美国总统奥巴马重申了其完成跨太平洋合作伙伴关系(美国与11个太平洋国家之间的贸易协定)的雄心。与此同时,欧盟和中国也在加紧完成它们在亚洲和其他地区的贸易协定。如果这些方兴未艾的贸易契约想促进发展中国家增长的良性循环,那么它们不但要降低贸易壁垒,还必须建立现代经济的制度框架,其中就包括强健的知识产权权利。

一些活跃分子和政府官员认为知识产权保护和经济增长不力之间有很强的关系,认为知识产权权利是发展的障碍,因此应该等到国家步入高收入行列之后再考虑实施。这一思想在印度尤其普遍,也是其与欧盟贸易谈判最近无法取得进展的原因;与此同时,这一思想也是全球贸易谈判多哈回合失败的核心因素。正如印度商务部长莎玛(Anand Sharma)所指出的:“发展中国家必须获得内在灵活性”。

但实际上受知识产权权利保护的思想乃是发达国家和发展中国家增长的动力源泉。印度等发展中国家不应该淡化知识产权权利,而是应该认识到强化知识产权保护乃是吸引外国投资的先决条件,而它们正需要外国投资助推经济增长、就业创造、提高人民消费力。
