与大部分出于政治动机的审判不同,季莫申科的案子因欧洲人权法庭(ECHR)的监督而受益,ECHR最近作出裁决,季莫申科审判前羁押违反了欧洲人权公约(European Convention on Human Rights)。但亚努科维奇继续装作尊重法治,称自己不能考虑给予季莫申科总统特赦,除非法律程序全部完成。
