2006年5月1日对欧洲而言是个关键日期,因为它是在各国国内法律中贯彻欧盟关于人员流动自由的指令的最后期限。大多数国家已经修改了他们的移民法,或已经承诺在最后期限前这样做。迟迟不动的国家只有比利时、意大利、芬兰和卢森堡。

的确,有的老牌欧盟国家选择了在过渡期禁止劳动力迁移。这一过渡期初步设定为两年,并有可能延长到2011年4月。但是,这一禁令不适用于自由职业者和无业者。这些人员已经享受到了完全的迁移自由。

尽管该指令中有关从业人员和自由职业者迁移的规定和以前的欧盟法律大同小异,但无业的欧盟公民迁移和社会福利的权益则被显著地扩大了。根据该指令,每一位欧盟公民都有权在任何一个成员国获得长达五年的居留许可,并在此基础上获得永久居留权。原则上,甚至非活动移民届时也和普通国民一样,有权享受社会福利。
