大阪——中国、台湾及若干东南亚国家之间的领土和海洋争端打破了南中国海地区的平静,上述争端不太可能迅速得到解决。不过只要借助多边论坛树立信心、保持对中国的有效遏制并承诺不使用武力,目前的现状或许可以维持。

中国自然急于排除区域外大国、尤其是美国的干扰,宁愿与更容易操纵的区域小国通过双边谈判解决问题。但区域外大国特别引用保障航行自由和无害通过权的联合国海洋法公约来证明自己有理由参与。

鉴于南中国海争端来自主权要求重叠的“专属经济区”而非公海,在此并不完全适用联合国公约。但另一项国际条约的确能为解决此类纠纷提供某些指导原则:那就是签字生效于1952年、正式结束亚太地区二战的旧金山和平条约
