肾脏待售?

发自普林斯顿大学——上个月纽约警方逮捕了列维-伊沙克·罗森堡,声称这个布鲁克林的商人正试图为一宗叫价16万美元的卖肾生意做中间人,事有凑巧,千里之外的新加坡刚刚通过一条新的法律,有人说这条法律将为新加坡器官交易市场的形成铺平道路。因为就在去年,新加坡零售业巨头董伟双因同意非法购买一个肾而被判入狱一日。但随后,他却获得了另一个肾——取自一名被处决的谋杀犯——而此举虽然合法,但在道德上却比买一个肾更具争议:因为这将激励(司法部门),使之更倾向于将那些身犯死罪的人定罪,并处决他们。

如今新加坡已将有偿捐献器官行为合法化。官方的说法是,这些报酬只是为了补偿捐献者所付代价,而政府依然禁止受捐者支付超过某个额度并被判断为“不正当诱因”的报酬。但具体如何界定“不正当诱因”,这在法律上则依然是空白。

而在器官捐赠领域的这些上述新进展令“究竟贩卖器官是否属于犯罪”这个问题再次浮现出来。仅美国国内,每年就有10万人在等待器官移植,但最终只有2.3万名病人能够得偿所愿,还有6000人没能等到合适的器官就已经过世了。
