达沃斯—在法国讽刺杂志、巴黎《查理周刊》遭遇恐怖袭击的背景下,“我是查理”的宣言响彻全世界。事实上,《查理周刊》应能自由地刊登它想刊登的东西而不必担心暴力,只要它本身不直接煽动暴力。但这意味着其他新闻机构和个人应该转载它吗?

平心而论,言论自由应该永不遭遇镇压,美国最高法院法官霍姆斯(Oliver Wendell Holmes)在一宗与美国宪法对自由言论的保护的案例中,通过反对意见强调了这一点。“[我]们永远警惕抑制被我们讨厌、认为充满了死亡的观点的表达的图谋,”他写道,“除非这些表达构成了紧迫的威胁,立即与法律规定的合法和紧要目的相违背,让我们不得不立刻予以抑制以拯救国家。”
