本月对于欧洲的人权事业来讲是糟糕的一个月,因为塞尔维亚被允许开始在欧洲理事会,这一欧洲大陆最古老的政治机构履行为期6个月的主席国职能。欧洲理事会,这个一向以推动人权和法制为目标的机构,现在就处于塞尔维亚的执掌之下。该国不但对《危害种族罪公约》嗤之以鼻,还为受到战争罪起诉的嫌犯,前波斯尼亚塞族军事首领Ratko Mladic提供庇护。此外,欧盟委员会已经表示准备好一旦改革派政府在贝尔格莱德组建就重开旨在拉近塞尔维亚与欧盟关系的谈判。

今年早些时候,国际法院判定塞尔维亚因未能防止Srebrenica的7000名波斯尼亚穆斯林男子遭受屠杀而有罪。该法院同时宣布只要塞尔维亚不将Mladic移交给位于海牙的前南斯拉夫国际刑事法庭(ICTY)它就在继续违反《危害种族罪公约》。Mladic被认为要对欧洲自二战以来最为严重的一些罪行负责。

但欧盟似乎决意忽略塞尔维亚对国际法的藐视。它迫切支持塞尔维亚的亲欧洲政府是情有可原,因为这可能使塞尔维亚不得不接受卡索沃独立的前景。这也就解释了为何欧盟的一些成员国急于就《稳定与联系协议》重新开始谈判。由于塞尔维亚未能与ICTY完全合作使该协议在一年前被迫中止。欧盟提出的转机意味着的逮捕和向海牙移交Mladic不再是重启谈判的条件。
